Το ζήτημα εδώ είναι πράγματι για «πνευματική ιδιοκτησία», ωστόσο δεν έχει να κάνει με «πνευματικά δικαιώματα» (Copyright) που σχετίζεται με το πως λειτουργεί το ελεύθερο λογισμικό, αλλά με «σήμα κατατεθέν» (trademark), στο όνομα JetBrowser/Jet-Browser. Είναι σημαντικό να διαχωρίσουμε μεταξύ των δύο, και ότι εδώ απλά τυγχάνει να πρόκειται για ελεύθερο λογισμικό. Στο χώρο των trademark, είναι στο χέρι του καθενός να υποστηρίξει αν κάτι μοιάζει με υπάρχον trademark. Για τυχόν σύγκρουση μεταξύ δύο trademark, πρέπει να εμπορεύονται στον ίδιο χώρο (π.χ. τεχνολογία λογισμικού, οικιακές συσκευές). Για παράδειγμα, η Microsoft κατάφερε να επιβάλλει την αλλαγή του ονόματος στο έργο wxWindows (τώρα ονομάζεται wxWidgets). Το σημαντικό σε αυτά είναι να επιλύονται εξω-δικαστικά για την αποφυγή εξόδων. Και όποιος είναι ο μικρότερος από τους δύο, να γνωρίζει με σαφήνεια πως λειτουργεί το σήμα κατατεθέν ώστε να ξέρει μέχρι που μπορεί να φθάσει.
