Man sues over kidney

KAMPALA – A man who claims he donated his kidney to an ailing woman, has gone to court claiming compensation.

Mr Faisal Mabanja, 28 , a builder and resident of Bweyogerere, a city suburb, claims, in documents submitted to court, that he agreed to donate his kidney to the wife of Dr Joseph Ssenyonga.

He claims that he was supposed to be paid Shs 50 million but only received Shs 4 million.

Through Luzige-Kamya, Nakayi & Co Advocates, Mabanja has taken Dr Ssenyonga to the High Court for alleged breach of contract.

According to court documents seen by The Monitor, Mabanja claims that he was taken to Kenya on January 14, 2002 where tests were carried out on his blood, stool, urine, and saliva samples at Kenyatta hospital.

After he was found to match with Dr Ssenyonga’s wife, Harriet, he allegedly was taken to the Civil Hospital in Mumbai, India on March 23, where his Kidney was removed and transplanted into Ms Ssenyonga.

He claims that he did not get the money he was promised and that his failing health now has curtailed him from doing any work.

He is seeking Shs 50 million as the contract sum, general damages for breach of contract, special damages, 25 percent interest on those sums and costs of the suit.

The case is yet to be allocated a judge.
