Joseph, great clarification. I lamented my email as having missed the point in IRC (doing to many things at once), but had to run off to a meeting and didn't have time to clarify here. Your exactly right, it does boil down to contracts and who owns what in the end. At the same time, it is important to note, that onus lies with the developer as noted in the article.
