This basically amounts to asking whether the API for openssl 0.9.8a is backwards compatible as far as 0.9.5a - that is, there are various function calls in mod_ssl 2.6.6 which expect to be understood by the OpenSSL library. If the interface to the library has changed at all since April 2000, the answer will be "no" (I'd be astonished if it is "yes").
It is not unusual for people to be a version or two behind with their various apache components, but you seem to be in an extremely complicated position. Apache 1.3.12 is not only ancient (July 2000), by comparison with a modern version, it is buggy and insecure. You are doing no-one a favour by keeping it on the internet. Rather than pottering about trying to fit a hydrogen fuel cell to a Morris 1000 Traveller, I would invest the effort in modifying whatever application that forces you to use apache 1.3.12 so you can upgrade apache to a recent version.
