Fixed it; 

even under nginx, RC was reading its old apache .htaccess file where the
limit was still set to 5mb. i assumed this file would now be ignored
under nginx. I was under the belief that nginx doesn't even read these
files. 

so perhaps still just an aesthetic issue? I haven't tested yet since i
thought to check there before trying otherwise. i will test...
