Both questions are fascinating and timely, Scott.  Worthy of extended
discussion and investigation.

It seems to me that Kastenmeier was obliquely born out of the Sony/Betamax
case, which, as you know, established the right of individuals to tape
programming off-air.  As I mentioned, the guidelines are just that: 
guidelines.  They were developed around the time the 1976 copyright act
went into play.  Because the Kastenmeier Committee was too late (or too
ineffectual) to get these sewn into the fabric of the law itself, they
were
flown forward as a kind of non-legal ancillary and read into the
legislative record.  The historical sense is that, although not formally
binding or legal, they'd be leaned on heavily as an indicator of community
practice in any litigation.

This said, I think--and this is JUST my personal opinion--that they have
very little relevance in matters related to downloading and retaining
online moving image content.  The content ownership and legal
underpinnings of the latter really have nothing whatsoever to do with the
stuff addressed by Kastenmeier.  For one thing, content ownership and
provenance of TV program is fairly clear; the same can't even vaguely be
said of online content.

I guess the above has a lot to do with your second question also (which is
definitely the more interesting of the two questions).  Even if
Kastenmeier DID apply, the guidelines have definite retention strictures
which would make long-term retention problematic.  Still...I think that we
need to be addressing this issue as more and more significant cultural
"stuff" makes its way online.
