Neal, the earpods that came with my iPhone 5 did not have the microphone problem you are describing but they were defective in that the volume down button on them had no impact when depressing it. I took them back to the Apple Store and exchanged them for a new pair which have worked flawlessly. So, it seems likely that you've gotten a bad set that need returning.
