In the early days of CF I talked with some SALT treaty people at LANL about the legal implications of cold fusion. Basically, if a device is not producing neutrons or is using materials with none-natural isotopic materials it seems to fall outside of the legal jurisdiction of such treaties and organization.
Basically the "system" did not anticipate "nuclear" systems that emit no neutrons.... go figure. I am not sure that a "proton capture" device would fall within the jurisdictions of the NRC. Perhaps some other group that governs low level radiation.
