Forgone opportunity is (so far) just a bugaboo.  The only time that anyone
actually went to court claiming forgone opportunity it was white commercial
fishermen; they lost their case.  This was one of the biggest arguments that
the anti-moratorium people could come up with, as a matter of fact I don't
recall the tribes even mentioning it during the run-up to the hearings, but
the whack-'em-n-stack-'em boys sure did.
