According to our legal advisors, the redistribution is referencing
the whole of WebObjects - tools, the whole works - and prohibiting
their redistribution but then granting limited redistribution
rights. The fact that the license specifically authorizes us to use
our applications built with the WebObjects Software implies the right
to redistribute those pieces of the WebObjects software required for
our own software to operate.
So the view that we are taking is that we could create an install CD
with our WebObjects application including the WebObjects frameworks
required to deploy the application on any platform.
What we can NOT do is simply redistribute a copy of the WebObjects
Software on its own or with tools or components that are not required
as part of the development. So we can't redistribute the WebObjects
tools, for example.
Apple could make the whole thing a lot clearer for everyone, of
course, by specifically citing examples of what is and is not permitted.
I believe that creating a VMware Virtual Appliance containing our
WebObjects application along with the OS and the supporting
WebObjects frameworks pre-installed is permitted under the license as
it is written and is really no different to shipping the application
on CD to deploy the application.
Creating a VMware Virtual Appliance containing just the WebObjects
software and not our own WebObjects application that requires the
WebObjects software could be a breach of the licensing terms. So I
think that Cliff is correct in his assessment of this point.

That would seem to be entirely legal based upon a reading of the

I'm not a lawyer, but I just looked at
/Library/Receipts/DeveloperTools.pkg/Contents/Resources/
English.lproj/Licens
e.rtf
and saw that redistribution *is* prohibited, except "Subject to the
terms
and conditions of this License, you may also deploy server
applications
built with the WebObjects Software on any platform." Get your
friendly
local lawyer to interpret that, but *personally* I feel that posting
pre-installed WebObjects images would be stretching the
interpretation.
