Jill,

 

HHS provided the following guidance in the Preamble to the (initial) Privacy regulations:

 

"The term 'medical and other health services' means any of the following items or services..... (6) durable medical equipment....."

 

So, if the provider of those services conducts a HIPAA-specified electronic transaction in regard to its services, the provider may be a CE.
