The GPL only applies when you do two things. 1. Modify the source code 2. Distribute the source code.
Since you are not modifying capistrano and are not distributing the modified version of capistrano you should be OK. It sounds like your lawyers are confused. Maybe you can create a separate repository for your capistrano files. Better yet run your capistrano scripts from a pristine laptop bought just for that purpose and nothing else. That way you can convince your lawyers you are save.
