The words look and are spelled the same but they have very very
different meanings.
Anything that is patent encumbered is NOT free as in "freedom" or
"liberty".
I think that depends on what the owner of the patent desires; that
can vary from non-enforcement, through a broad no-cost grant, to
revenue-bearing but non-discriminatory, through to unwillingness to
license.
