The way Microsoft promoted this "beta" product to the public is different from the way they've handled any other beta of their usual software in the past. I think it's safe to say that this "beta" is unique and intended for a wide audience of home users.
My opinion, Microsoft wanted to do something to get brownie points in the anti-spyware game so they made this available before their legal dept. could sign off on it as a "fully-backed Microsoft product." Meanwhile, the legal dept. is dragging their feet trying to figure out they will defend the company against spyware purveyors who don't want to be tagged by the product - i.e. Microsoft - as spyware.
