I seem to remember, from my days with JAWS 4, that it would be read
out as "List with 3 items....bullet; 1 dash..." etc

I think that this (particularly the "legal document" case) is a
scenario in which we have to recognise that there *is* no widely supported
semantic equivalent. Yes, it's an ordered list, but we can't use it and
then rely on CSS 2.1. In an ideal world, sure...but not in the foreseeable
future. Anything that displays ok in IE and text-only/css-less browsers
will have to do, imho.
