A best practice: Do browser detection instead.

<script type="text/javascript">
function html5elm(elm) {
        return !!document.createElement(elm);
}

var myArray = ['header','nav','section','aside','article','footer','hgroup'];

for (var i = 0; i < myArray.length; i++){
        html5elm(myArray[i]);
}
</script>

It will create those elements for IE6-8 (and older browsers with lack
of HTML5 support) in DOM. IE9 support them natively.
