Oops, something must have gone wrong there ... I'll see about updating the macports ticket (should I give that priority over other things on my plate?); given the lack about enthusiasm there I had given up on that. As you can imagine the logic of getting these patches into MacPorts is a bit more complicated than simply incorporating them into something that's distributed as a binary installer. There are no legal issues for regular desktop use that I'm aware of, but there may be other Freetype applications where those remaining patches do represent some kind of problem.
