Yes, the team responsible for that code has indicated the same thing to me.

A fix could be made in libXplugin, but it would need to be a rather large 
architectural change such that libXpluin would need to record all surface layer 
odering (right now, it just passes on the request from X11 to OS X and doesn't 
maintain the state).  This would be a huge effort and not worth the engineering 
effort.  If anyone actually had such time to devote to a solution, it would be 
better spent working on libxcwm+XtoQ or an AppKit based Wayland compositor 
(+XWayland).
