I've been updating the Apache copyrights in our code to the license headers
found at http://www.apache.org/legal/src-headers.html#faq
The ASF would prefer that only the Apache license header be in the parts
and that other copyright information be moved into the NOTICE file. In
particular at the webpage noted above it says this:

If the copyright owner is still involved with the project, they should move
the notice themselves or permit us to do so.
If the owner cannot be found, the copyright notice should be left as is,
but the new licensing header should be added
or substituted for any existing Apache license header.

Everything is going fairly smoothly except for the testcases in
test/tests/contrib/xsltc/mk which are tests from Michael Kay and Wrox
press. In particular most of the .xsl files in that directory have this in
them:

While these test are not part of our "distribution" they are in subversion
and anyone can down load them. The tests were contributed through Tom
Amiro in July of 2001. I do believe that Tom (and therefore the ASF) had
permission to use the tests. I'd feel comfortable leaving the Wrox
copyright in the files, but it is the sentence about not storing or
transmitting it without prior written permission that bothers me.
Apache may have permission to store these tests and transmit them, but the
question is, what if someone downloads these tests from Apache, which is
quite likely. Many users and contributors have downloaded both the project
with the code, and the project with the test harness and testcases. The
Wrox tests are not being stored an transmitted within the ASF, and the ASF
is contributing to that by having them available through subversion.
I think this is a problem for the ASF. (Let me know if you disagree).
There are three things that I think we can do:
1) Delete the directory test/tests/contrib/xsltc/mk in Subversion. I'm
sorry about this, but who is using these tests now? I think that we have a
bigger test bucket than in 2000.
2) The owner, Wrox press can be found, so we should contact Wrox and ask if
we can move the copyright out of these parts and into the NOTICE file.
Still I don't see what we can do about the
"reproduction/storage/transmission" clause, and I don't think our users are
going to get prior written permission from Wrox.
3) Leave them alone, that is how they have always been.
I am strongly in favour of choice 1, and I don't think we can find our
"written permission" that we once had.
Your thoughts on this please.
