The schema is invalid. Please refer to Eddie's reply.
And Xerces does report an error if the "schema-full-checking" feature is turned on. (-f option on the samples.)

Thanks for the clarification.
It (xerces-2.0.2) also needs the patch at http://nagoya.apache.org/bugzilla/show_bug.cgi?id=11323 the way I ended up testing it. But thats a by the by, and I had indeed forgotten to turn on the full checking feature.
