POPCRU has interdicted DSC
 
POPCRU has applied for a Labour Court interdict in relation to a matter of 
Shift 
System involving the Department of Correctional Services, in which employees 
are 
required to work 10 hours[including 1 Hour lunch break],for 10 consecutive 
days, 
after which the employees are granted 4 days off at the Empangeni Management 
Area, Kwazulu-Natal.
 
The employer is amongst others ordered on the following terms;
 
        * Interdicted and restrained to implement a shift system in terms of 
which 
employees are required to work 10 hours shifts[including 1 hour lunch 
break],for 
10 consecutive days, after which the employees are granted 4 days off;
        * Ordered that the relief granted as an interim interdict pending the 
resolution of the dispute at the General Public SERVICE Sectoral Bargaining 
Council; and
        * Ordered that the employer as the Respondent to pay the costs of the 
application
 
The purpose of the application is to obtain an interdict against the department 
to restrain it from implementing a new shift system in conflict with the 
provisions of Section 9,10 and 15 of the Basic Conditions of Employment Act,75 
of 1997,pending the outcome of a dispute that has been referred to the GPSSBC.
 
The matter will be heard at the Labour Court on the 07th September 2010 at 
10H00 
in Braamfontein.
