SUBJECT: REQUEST FOR AN ADMINISTRATOR
The FET sector will once again undergo major changes brought about by
the amendment of the FET Act of 2006. The new Act could be promulgated
at any day now. The department of Higher Education and Training is
already preparing for taking over the 50 FET colleges from the
provincial departments of Education. We welcome this move but our
management and the college council has neglected us as the large
stakeholders of the college and this resulted in us receiving an ill
treatment from them.
Your intervention will assist in making sure that we all receive
uniform treatment. We always have to fight for assistance from top
management and the college council. In terms of the new act, employees
will be transferred back to the state, under the Department of Higher
Education and Training (DHET). This is a process that will need to be
monitored closely to ensure that it is transparent and fair. This
means that we need to be vigilant and make sure that we know what is
happening in our institutions especially on Human Resource matters to
stop nepotism which is currently dominating our college.
Hence the top management and college council they don’t inform us on
these developments. Request of meetings are always regretted by the
acting Rector so is the college council continuously failing to hold
meetings more than three times now. Issues escalating from last year
are in one agenda and the college council can’t finish that agenda
(ref. ANNEXTURE B). Worse part of it all is that the current college
council does not meet a required quorum by the FET Act. Legally
speaking all their decisions can be challenged in court without a win
as many cases attest to this fact and in some meetings minutes of
previous meetings are not available.
As we speak we are not informed of what is happening within the FET
sector. We are of the view that the top management is failing to
manage the college and the current college council does not have a
capacity to govern the college.
We request the department of higher education and training to come
into our rescue in other to protect the well fare of the college,
staff and the future of students.
It is regrettable that the staff at large has voiced their concern
against the appointed acting top management because of their
suspicious track records against them and also launched a memorandum
of grievances (ref. ANNEXTURE 1A) towards the top management and
towards the close of 2011 we submitted a vote of no confidence (ref.
ANNEXTURE A) towards the top management through the chairperson of
college council.
We therefore lack but we also seek clarity on the following:
1. Transitional issues like
• movement criteria to DHET
• salary structure
• new conditions of employment
• staff benefits
2. Outstanding issues like
• housing allowance including collective agreement No 4 of 2010
• provident fund from sanlam including 5,5% that is owing from 2009
• contracts that are different from each other
• medical aid
• 1% pay progression
2. No feedback on investigation done against fraudulent activities.
Resources disappear without a trace or unaccounted for. (for this
ANNEXTURE C refer to the college council).
3. Management and Council do not adhere to court and currently there
is court order against college (refer ANNEXTURE D).
Student’s issues
• The current top management led by Mr. PC Tigere fired Job Placement
officer in August 2011 and at that time he placed over 300 students
but they did not even replace him in order to make sure that students
get placed in job industries.
• This management and Council Chairperson attended meeting with DHET
and state President on the 04th April 2012 but even today we have not
been given feedback of that meeting.
• All campuses are falling apart having to operate without approved
budget at this time of the year.
• NSFAS – students have not been told if they got 2011 bursaries or
not. This year students are still asked to apply again but even now
there have not been given transport and accommodation allowances to
those without residences.
• Investigations conducted yet people are not charged therefore the
state money goes to waste but this current leadership is there.
• Safety – student throughout the CoastalKZN FET College does not have
anything proving that there are student from this College, thus
finding that in campuses everyone is entering without having to show
prove of registration and mugging taking place.
• All student residences are not in good state for a human being worse
for a student expected to excel in his/her academics (Umbumbulu,
Umlazi V and As-Salaam)
We therefore ask for the intervention of the Minister’s office in
order to make sure that our institution is saved, very disappointingly
this management still does not see/want us to report and I quote Mr PC
Tigere “to report to the ministry this inability to meet would send a
wrong message and I would not support it. Members of council are
committed to the college and that is what you are known for and let it
be so .We need to remember that your lives do not stop at CKZN and
should not be tainted”.
We will not be shy just because we want to pave our way and make good
name by keeping quiet as things are falling apart.
These are the burning issues among others. We request your response
urgently by 7th of May 2012. There will be a demonstration of
unsatisfactory on these issues by the staff and students from the 9th
of May 2012 if there is no positive response.
