DA court challenge on Nkandla task team report 

 

 

The Office of the ANC Chief Whip is not surprised by the DA's opportunistic
and attention-seeking decision today to approach the courts regarding the
task team report into Nkandla security upgrade. The report is currently
before parliament's multiparty joint standing committee on intelligence, and
the committee is set to report back to parliament at the conclusion of its
work. 

 

We have become accustomed to the DA's tendency to undermine the
constitutional functions of parliament by constantly calling on the
judiciary to interfere in matters before the institution. 

 

In the last 11 months alone, the DA has already gone to court three times to
challenge matters before this parliament. Recently, the Constitutional Court
dismissed with costs the DA's application for the court to instruct
parliament on how it should decide its programmes. A few weeks ago the party
went to court again, this time to ask the judiciary to force a parliamentary
committee to include DA's demands into the draft electoral amendment bill. 

 

Such continued blatant contempt for the doctrine of separation of powers
makes a mockery of the DA's role and its representation in this parliament. 

 

By rushing to the courts and abandoning their obligations in the committee,
where representatives of various political parties are interrogating the
report, the DA is missing a valuable opportunity to be part of the process
and satisfy itself of its quality and integrity. The DA, as always, seems to
be more interested in headline-grabbing side shows rather than engaging
meaningfully in parliament. 

 

We are confident that the parliamentary committee's work on this report will
not be distracted by the DA's shenanigans.
