The court ruled on Friday that the Gauteng education department had has 12 months to set fresh rules for determining feeder zones for the province's schools. The nation's highest court made the ruling in the long-running case about admissions regulations between the department and the Federation of School Governing Bodies of South Africa (Fedsas). The ruling was delivering by Deputy Chief Justice Dikgang Moseneke The union said it was their long held view that school governing bodies in former model C schools, misled by Fedsas, manipulated legislation to preserve their racially discriminatory policies. Tseliso Ledimo-Provincial Secretary said, "These schools charge unreasonably high fees and continue to accumulate huge reserves. They have created different conditions of service in the education system through the provision of additional perks and bonuses for state employees not determined in the relevant bargaining councils." The union has said that it firmly supported the principle of universal access to public education for all children. In its reaction the Gauteng Department of Education said the judgment "confirms that all schools are open to our children regardless of income status, academic performance or race". SADTU has also called on the Gauteng Department of Education to be even more radical and accelerate transformation in pursuit of quality public education for all children.
