Once mac spoofing was enable and for good measure static mac assignment
everything started to behave as required...
For those using HyperV 2012 R2 the key was to assign a port profile with mac
spoofing enabled, once I found that it worked nicely.

I just finished setting up a cluster on vSphere 5.0, and the setting that I
changed to fix this problem was in the portgroup security settings on the
virtual switch -- just set the portgroup to accept Forged Transmits. This
allows VM traffic to come from MAC addresses that aren't registered in the
vmx file.

Hi, it's not still available through the GUI but you could always use
iptables to do that.
