When this was added, Zenoss Inc indicated that they had a separate 
agreement with Google plus distribution rights to cover that issue (that 
is, Zenoss installs can "ignore" that section 9.1).

I'm not sure where that was posted besides the forums, so a forum search 
may be in order. I think this probably is a missing bit of 
documentation, and may need to be an added license document that Zenoss 
hands out with the install.

I assume if you take the GPLed version of Zenoss and were going to 
rebrand and redistribute, you'd have to get your own Google agreement 
though.
