The previous Act was framed and enacted in the 90's and has largely been
based on charity model. In the last 15 years, besides empowerment we
have also seen the emergence of UN Convention for the rights of persons
with disability, which is entirely rights based. Since India had been
one of the first to sign and ratify the convention, it is important for
our country to enact a disability law consistent with the international
convention. Hence the campaign to replace, and not to amend, the Act.

While it is true that there are many shortcomings with the existing PWD
act, 
one wonders whether the need for a new law, as advocated here, is what
the 
entire disability sector wants. Further, what is also not clear is
whether 
the new law will completely replace the current act or would come as an 
extra act protecting the rights and requirements of the persons with 
disabilities? What would be the basic tenets of the proposed new law?
Why is 
it that the current act cannot be suitably amended to make it aligned to
the 
provisions of the UNCRPD? Has there been any attempt in the past to have
a 
consensus among different individuals with disabilities and/or various 
disability groups in this regard? The pledge claims that the existing
act 
and its proposed amendments do not represent the voices of disabled
people. 
If ushered with lack of sufficient debate, the new law may meet the same

fate, after all. On the contrary, if carried out with a sufficient 
discussions amongst stakeholders with all disabilities, even the current
act 
can be suitably amended and be made in tune with the UNCRPD, I think.

So, before making our mind to support the pledge, it would be more
positive 
to hear from each other on these and other possibly related aspects.
