If you own the phone in the US, you can do what you want to with it. I do not know about other countries. However, if you are on contract and/or using the services of a mobile network provider, or if you have the phone insured or under warranty, it may be against the terms of your contract. And I guess that would be considered illegal. You can read said contracts or call the 800 number of whatever company and talk to someone for details.
