Another thing to remember with legal claims and copywrite, is that often solicitors are employed basically to scare people, even if the grounds they're working under are legally dodgy or just plane made up, this is something my brother actually confirmed, and he's been working as a solicitor for the last six years, and it's one reason why there are certain areas of law he stays out of since he prefers cases that are morally okay.
To give an example, a few years ago a firm who had recently bought property behind my parents house sent a letter supposedly "advising!" that my parents' back fense had been extended beyond the boundaries of what property they owned and asking it be moved by about three meters.
This was complete, total, utter and absolute rubbish! since on the original property plans which have been held at my parents' solicitors ever since the 1950's, the boundaries are clearly marked. this was just a case of a big fat coorporation who wanted a little extra room to install a garage sending a threatening letter in the vague hopes they could get something for nothing, and needless to say my parents property solicitor told them where to get off.
Unfortunately, certain branches of law are full of this sort of thing, and copywrite in particular. This is one reason I'm a little sorry Thomas ward abandoned Montizuma's return after recieving the cease and desist order rather than taking things further, though I don't blaime him for doing so.
With audio games, where there's a pretty good case saying that your not actually taking away from any copywrite holder since they don't produce something comparable, especially when stuff is freeware and under gpl anyway, I'm less certain myself, and as evidence go to somewhere like pendent productions or broken sea and have a look for starwars stuff, not to mention sites like retroremakes.
