As asked here, here are the references to low/high tow from GFA http://2009.gfa.org.au/Docs/ops/AerotowManual2006.pdf
It appears from that manual that pilots are allowed to do either. "The glider pilot may choose to remain in high tow throughout the entire tow." Hopefully that should put to rest the legal aspect. Scott
