Go to the nd land dept minerals management page and check out paragraph 9 of the sample state lease.
ND requires drilling or royalty payment or release of the lease or a waiver of this provision granted by the ic even if a well is not even the state land but is adjacent or within 1000 feet of the state leased land. Companies agree to these leases all time at the state auctions. Companies may agree to the language that you posted but the state language obviously requires more on the part of the company.
