Doing some rules nitpicking to confirm things in my mind;

(1)
Four situations:

1. The thrower pivots into a stationary marker = O foul
2. The marker moves into a thrower = D contact
3. The marker moves towards the thrower as they pivot into the marker = D 
contact
4. The marker is moving backwards as the thrower pivots into the marker = .....?

Everyone always says "It's always a D infraction if the defender is moving at 
all" ...but the letter of the rules says "However, if this contact is caused 
solely by movement of the thrower, it is not an infraction."

In situation 4, it is assumed that the D player would have been fouled if they 
had stayed still, but was moving backwards for whatever reason - away from the 
thrower - so how can their movement have caused the contact?


WWJD?

Can a thrower choose whether to call Foul or Contact when their marker contacts 
them?  I think the answer is yes - presumable to allow the thrower to maintain 
some fluidity to the offensive play.
