I agree with that part.

My US history is a bit hazy but I always thought this is what happens.
President asks for declaration of war.  Congress votes no.  Presidents
invokes some act claiming the US is in peril and take unilateral.
Presidents mobilizes military forces.  Congress throws a hissy fit and
demands the President stops.  The president claims he didn't have time to
ask Congress properly again due to the time constraints caused by the
threat.  Congress votes to ask the Supreme Court to declare the President's
actions unconstitutional.  Various other bills and acts are added to the
one voting down the military action.  Vote fails.  President conducts a
"Conflict".

The thing I didn't know was that the draft can happen without the
declaration of war.
