In terms of the Senate bill the biggest problem I see with it is its
attempt to skirt the justice department of the united states.  The
whole purpose of the justice department is to regulate the legislative
folks.  Without that balance, the legislators can do whatever the hell
they want, without any regulation.  That sucks.

This discussion:
So Issac, you are saying we should distinguish between a rape that is
violent in nature, to perhaps one where the victim is unconcious?  I
kind of agree - although the sentencing for rapes of non-violent rapes
of children should be just as severe as violent rapes of children.

Or perhaps rape is one crime and assault is another - so if you commit
a violent rape you get convicted of both assault and rape and if you
commit a non-violent rape you just get convicted of rape?

Right -- though the qualification in my mind isn't really saying that
this is an exception to the rule of no laws governing sex between
adults, but rather that there are certain circumstances which are
inclusive of sex in addition to some form of violence which should be
punished. It's the violence that should be regulated, not the sex,
even though in the case of rape for instance the two are pretty
closely tied. But still -- I think we should make that distinction
especially in our laws between sex and violence and what it is that
we're punishing when we punish a rapist or other sex offender.
