Nope. If a person was a citizen, and turned down for the job, then it would be 
discrimination based on national origin.

Discrimination based on country of citizenship is perfectly legal, I think.

It is even legal to discriminate based on state of residence (no out-of-state 
applicants need apply)

The list of things you cannot discriminate on is actually pretty limited.

For example, it has been deemed perfectly legal for Hooters to not hire men, 
since hot women are part of the business model of the place.

(And yes, I assume this will open a can of worms)
