Look into saboteurs and spies in the rules of land warfare.  However I still
wouldn't like to see these rules applied to American citizens.

What army do they belong to?  What country do we go to war with?  Being able
to define them is a requirement of it being an act of war vs a criminal
action.

enemy. Then they can be declared an enemy combatant and given a
military tribunal.
