That isn't true...the Barbary Pirates were part of governmental entities
that we had emmissaries/ambassadors posted to.  Alqueda is an underground
terrorist group.  They are not a government...nor do they claim to be.  They
didn't commit an act of war, they committed a criminal act or terrorism.
