The question wasn't "should we fight against Al Queda and terrorism", the question was "can we actually declare War". There is a solid argument that the US has steadily moved away from actually declaring its wars, ever since Korea. Many people think this is a bad thing for a variety of reasons. But in the currently conflict there is a question of whether we could formally declare war even if we had the political willpower to do so.
There is also another, related, discussion to be had about how this undeclared war against a tactic, terrorism, instead of an actual identifiable foe, leads us to a perpetual state of war and what effects that has on our country, our way of life and our freedom. Terrorism cannot be defeated, especially through military action. It can be lessened, it can be marginalized, we can put some of its purveyors out of commission. The continuing belief that we are at war with a concept fuels increased consolidation of executive power, the decrease in individual rights, outrageous deficit spending to pad the pockets of defense contractors and sets a national tone of constant fear and paranoia. Which is just what the terrorists wanted.
