Michael,
Can you base your test on the existence of CFTREEITEMKEY rather than the
value of HTTP_REFERER?  That is, use
  <cfif isDefined("CFTREEITEMKEY")>
rather than 
  <Cfif FindNocase("finduserby",#HTTP.HTTP_REFERER#) NEQ 0>
