Actually, they do separate the two. For extension development, obviously, it
will state both of them, since they are built the same way technically and
that is exactly what the developers are interested about.
But, they are separated. For example, a theme cannot have other
functionalities and a regular extension cannot include a theme, too (for
now). They are also installed in a different fashion, as you said.

Also, Chrome 3 came out with Themes, not 'theme extensions'. Chrome 4 has
Extensions and Themes.

Yes, both of them will be in the extension gallery, but themes will have a
separate section in the (near?) future.
