This sounds like a really nonintuitive UI. A lot of users manipulate menus by clicking and dragging, so releasing the mouse to click a checkbox would dismiss the menu.

Is there any reason you don't want to simply check/uncheck items in the menu? This is a much more common interface paradigm which users which will be much more familiar with. See NSMenuItem's setState: method for how to do this.
