Bzzz wrong, please try again: configure:PRIVSEP_PATH=/var/empty The configure script choose /var/empty by default. vdanen choose to use /var/empty/sshd by altering the configure call with this: --with-privsep-path=/var/empty/sshd Not only that but take a look at /usr/share/doc/openssh-*/README.privsep, vdanen didn't patch this file from it's distributed form and it references /var/empty not /var/empty/sshd.
