TWA 800 Whistleblower Contemplates Legal Action

Justice Department prosecutors and the National Transportation and Safety
Board deliberately misconstrued the facts in an attempt to persuade U.S.
District Court Judge Joanna Seybert that two TWA 800 whistleblowers belonged
behind bars.

That's the charge from James Sanders who, along with his wife Elizabeth, was
convicted in April of conspiring to steal evidence from the plane's
reconstructed wreckage housed at Long Island's Calverton air base. On Friday
Judge Seybert sentenced Mr. Sanders to three years of probation and 50 hours
of community service. Mrs. Sanders received one year of probation and 25
hours of community service.

Sanders tells Inside Cover exclusively that the government was downright
malicious in its attempt to make an example out of him and his wife. For
instance, in a letter written to Judge Seybert before their sentencing, NTSB
chairman James Hall claimed that Sanders had misrepresented the facts,
causing thousands of TWA 800 family members extreme grief, thereby unduly
undermining the credibility of the government's TWA 800 probe.

In 1997 TWA investigator Terrell Stacey gave Sanders swatches of the 747's
seat fabric which were stained with a red substance that laboratory tests
later showed was consistent with missile exhaust residue. Sanders described
the episode for his 1997 blockbuster, "The Downing of TWA Flight 800".

Sanders says prosecutors used overheated rhetoric and false charges in an
attempt to ratchet up his punishment:

"They tried to pile on, saying I obstructed justice by claiming that I told
a key witness that she could develop amnesia after she had received a
subpoena. I did tell her that, but it was before, not after, the subpoena.
But thanks to the Justice Department, the judge was led to believe it was
just the opposite."

Legally, it's far more serious to coach a witness once he or she has been
formally subpoenaed.

"The Justice Department was trying to set up a scenario that would warrant
putting me in prison for up to six months and fining me $5,000," said the
free-lance investigator.

Sanders believes that what the NTSB and Justice Department tried to do may
be legally actionable. "If the NTSB cannot back up the malicious charge that
I misrepresented the facts, and that's what caused all this pain and
suffering, then they are civilly liable."

The two federal agencies may soon see the TWA whistleblower again in court.
Sanders is currently huddling with legal advisors, contemplating the
feasibility of a civil suit that could blow the lid off the entire TWA 800
cover-up.
