Hi, I guess it's worthwhile to see how Earthlink's prior art defense (e.g., http://news.com.com/2010-1032_3-1003921.html) will hold up. I wouldn't write off this concept, yet. I've seen these kind of thing pop up and eventually die more than once (but, certainly, sometimes "sofware" patents turn out to be legit.)
