I think "encumbered" or "non-free" would be a better description to
use; non-free is what Debian, Ubuntu, et al. use today.

Ugly has a negative connotation about the software in question. The
software in question may be absolutely wonderful and is only weighed
down by idiotic software patents, etc.

However, this is a semantic nit-pick at best.
