Given how frequently some registrars rape other registrars Whois databases for renewals I don't think there is much chance of successfully arguing against "protecting oneself". This is also another reason why some registrars severely govern the rate at which you can query their Whois.
I'm espicially fed up with Register.Com doing this and physically mailing me creatively worded renewals in hopes I'll screwup and renew with them ... They also throw in variant names on top of it!

And some registrars (i.e. godaddy) will provide bogus information via
port 43 WHOIS to all of their competitors (yet they provide valid
information to all WHOIS requests coming from ICANN controlled
networks to hide what they are doing--talk about lack of ethics).
You know you've made the big time when your netblock is added to
their list.
