One last comment on this: Typical copyright assignment agreements transfer all rights in the code to someone else. (This typically includes not only copyright, but any other rights necessary to make use of the code, e.g., patent rights.) After that occurs, the original copyright holder has no more rights to the code than anyone else. In the US the original developer may not even be credited, unless that was specifically provided for in the agreement. (Other countries have a "moral rights" concept that changes this somewhat.)
