Regarding the application Icon, I see one with a TM here and others without:

think that cannot be tradmarked but would have to be registered?

I'm not the right person to reply to these questions (perhaps someone of the Oracle team can step in), but I didn't hear about any attempt to trademark the gull orb.

I've been told about three levels of protection:

The logo is covered by the trademark, while
the blue only gull orb (at the brandrefresh page with the "TM" sign) is covered by copyright - a decision about a open source license ("share alike" or something similar) has not been found. Based on this orb different versions can be created (shaded, 3D effects, following special designs ...), I think this is the reason why the application icon has no copyright sign...
