I don't think this is much of a threat - firstly, you're assuming that a
node operator who requests an illegal file will read it and then securely
delete it. I think node operators are far more likely to be caught with a
plaintext copy of the illegal file in their home directory than by the
investigators trawling through the datastore looking for the parts of a
splitfile. But if you think it's a likely scenario, perhaps you should
add an option to the node to drop one part of every multipart file that's
retrieved, after the file has been assembled.
Secondly, if one of your immediate neighbours chose to request a multipart
file through your node, wouldn't you end up with copies of all the parts
anyway? So you would have plausible deniability even if all the parts were
in your datastore.
