The point being that why do we even need to think about whether a mode is legal or not...
 
For example the combination of image and data in MFSK is illegal in the USA...
 
If we had bandwidth only regulation, then all modes and combinations thereof would be legal as long as they fit within the bandwidth...and we would not have to spend energy on regulatory nonsense...

It didn't help that a "citation" apparently from an OO was represented
as being from the FCC.  Correspondence with the FCC shortly afterward
confirmed that the mode was, and had been, legal in the U.S.
